EU charges VW, BMW and Daimler with 'collusive' emissions scheme

"BMW, Daimler and VW participated in a collusive scheme, in breach of EU competition rules, to limit the development and rollout of emission-cleaning technology for new diesel and petrol passenger cars sold in the European Economic Area," the EU competition enforcer said in a statement.

The Commission said the collusion occurred between 2006 to 2014 and took place during the automakers' technical meetings.

"Daimler, VW and BMW may have broken EU competition rules. As a result, European consumers may have been denied the opportunity to buy cars with the best available technology," European Competition Commissioner Margrethe Vestager said in a statement.

The EU focus is on selective catalytic reduction systems to reduce harmful nitrogen oxides emissions of diesel cars through the injection of urea, which is also called AdBlue, in the exhaust gas stream.

It is also concerned about potential collusion on "Otto" particle filters to reduce harmful particle emissions from exhaust gases of gasoline cars.

Damnliar faces up to $1.1B fine for diesel cheating.

The text of the law contained the phrase: "Fine for Cheating", so they thought it was OK to do.

PORSCHE ISSUES STOP-SALE ON USED VEHICLES
Automakers sometimes have to issue stop-sales on vehicles. That means there’s something wrong with them and they can’t be sold. It usually happens with a new car that doesn’t have the bugs worked out. But Porsche is going back in time with a stop-sale involving models built between 2012 and 2016 with the Sport Chrono Package. You hear right, these are used cars that can’t be sold because in the Sport driving mode they emit more nitrogen oxide than they’re allowed to. And this is not just one model. The 911, Boxster, Cayman, Cayenne and Panamera are all affected. What’s more, these cars will all need software updates, but Porsche still doesn’t have a fix, even though the stop-sale was issued in November of last year.

As soon as I was about to buy myself a Porsche of my dreams, they stopped selling models, but maybe there is an opportunity to get around this situation from the other side.

VW's 'temperature window' software is illegal, EU court adviser finds

"The case, brought by consumers in Austria, centers on software controlling a valve that recirculates exhaust gases from the engine outlet. This reduces emissions of nitrogen oxides (NOx), which can cause respiratory problems in humans.

The software shuts off the valve at temperatures outside the range of 15-33 Celsius (59-91 F) and at altitudes above 1,000 meters (3,280 feet), increasing NOx emissions. The consumers contend this is a prohibited defeat device, for which they should be compensated.

In his legal opinion, CJEU advocate general Athanasios Rantos noted the court ruled last December that emissions-rigging software was illegal, even if it contributed to preventing ageing or clogging up of the engine.

Rantos said the temperature window was not representative of real driving conditions in Austria and neighboring Germany, as the average temperature was significantly lower than 15 C. Vehicles would also often be driven above 1,000 meters
."

This is similar to FCA's RAM 1500 3-L V-6 diesel emission control issue. If they had called this out overtly and gotten it approved it would have been one thing, but the fines were about covertly making the decision on the operating window of temperatures where the emissions controls would be fully functional. There is a provision that allows this type of windowing, based on reducing "Harm" to the engine (clogging the particulate trap or the catalytic converter maybe?), but how narrow you make the window and not being up-front with it is what gets you in trouble. If this was NASCAR, they would have fined the crew chief and wrote a new page in the rule books to clarify the intent of the rules.

HINO ADMITS TO DIESEL CHEATING - Autoline Daily

"Just when you thought that cheating on diesel emissions was over, Japanese authorities jumped all over Hino, which is Toyota’s truck company. The transport ministry is revoking certifications of four engines because Hino gave them false emissions and fuel economy data, and Hino admitted it did it. This ruling also affects Toyota and Isuzu, who also use the engines."

SOME EUROPEANS STILL WANT THEIR DIESELS - Autoline Daily
Diesel engines used to account for half of all new car sales in Europe. Not anymore. Dieselgate and the availability of electric cars took care of that. Diesel sales have plummeted. But LMC Automotive says there’s a hard-core group of customers who still want their diesel engines. About 20%, or one out of five, new-car buyers in Europe order cars with diesel engines. In fact, diesels outsell BEVs and there’s even talk of a diesel resurgence. But LMC doesn’t put credence in any kind of diesel revival and predicts that BEVs will start outselling diesels in Europe sometime next year. Diesel sales are strongest in Austria and Germany and the weakest in the Netherlands and Norway.

I was at a stoplight yestidy and I noticed the Mobil gas station had Regular Unleaded for $3.99 per galleon. At the bottom of the sign, it showed Diesel fuel costing $5.39. That's a lot like 35% more expensive. Probably more than offsets the fuel economy savings of owning a diesel-powered vehicle, let alone provide additional saving to pay back the higher initial investment cost of the diesel.

Former Audi CEO Stadler to make diesel scandal confession

Stadler is ready to make a confession about his role in the scandal in exchange for a suspended sentence and a payment of 1.1 million euros ($1.21 million).
Prosecutors have agreed to the deal. A judge had said Stadler faced a prison sentence of 1.5 to 2 years, which would be suspended if he agreed to make a confession.
The deal follows haggling between Stadler's defense team, the prosecutors and the court, especially over how much money Stadler would pay in exchange for a suspended sentence.

Prosecutors wanted 2 million euros, citing Stadler's salaries at Audi and Volkswagen and his financial and real estate assets. Stadler's team had initially argued that 1.1 million euros was too high, as he had no current income and faced hefty legal costs.
